Are You Making A Good-Faith Effort To Accommodate Employee’s Religious Beliefs?

 

As Passover approaches and the Easter Bunny hops into town, employers should be mindful of the workplace policies that should be in place to reduce the risk of potential religious discrimination claims.

 

According to Title VII of the Civil Rights Act, employers must “reasonably accommodate” workers’ religious beliefs. While the numbers of religion-related claims filed with the federal EEOC are decreasing from an all-time high in 2011 of 4,157, the number filed in 2013 was still substantial at 3,721.

 

“Religious-based harassment claims can be just as costly and detrimental to a company as sexual or racial harassment suits,” said Michael V. Abcarian, regional managing partner of labor and employment law firm Fisher & Phillips Dallas office.

 

“Employers should consider three things with the religious holidays around the corner:  how can they proactively reduce their risks of a discrimination lawsuit, is it best to avoid all forms of holiday decorations in an effort to avoid offending an employee’s religion, and what should they do when accommodating an employee’s beliefs interferes with the productivity of the workplace,” said Abcarian.

DENNIS SIMMONS, CEO OF DALLAS-BASED SWACHA HONORED FOR HIS SERVICE TO THE ELECTROINC PAYMENTS INDUSTRY

Simmons Received “Distinguished Service Award” at National PAYMENTS Conference

 

DALLAS, April 8, 2014 – Dennis Simmons, the longtime CEO of Dallas-based SWACHA, was honored yesterday for his many years of service dedicated to the support of the country’s ACH Network. SWACHA is one of the largest not-for-profit electronic payments associations in the country.

Simmons, 65, received the “Distinguished Service Award” at the Chairperson’s Leadership Reception at the 2014 annual PAYMENTS conference in Orlando, FL., hosted by NACHA. 

“Today we are honoring an individual who has been an active volunteer and ardent supporter of the ACH Network and NACHA—and who at times is mistaken as a member of the NACHA staff for his level of involvement in programs and committees across both the Network and Association areas of NACHA,” said Pat Thelen, CTP, NACHA Board Chairperson and executive vice president at UMB Bank, N.A.

Simmons is an 18-year veteran of SWACHA and has led the organization since 2001. He has served as a NACHA board member and chaired the Electronic Check Council, Government Relations Advisory Committee, and Risk Management Advisory Group. Additionally, he has served both as member of the Board of Regents and faculty of The Payments Institute, and chaired the Association Executives’ Leadership Forum of the regional payment associations

Simmons was also a founding member of the board of directors of the Secure Remote Payment Council and a member of the Faculty and Advisory Council of the Bank Operations Institute at Southern Methodist University. He also has served as a member of the Executive Education Advisory Council of the University of Texas at Dallas.

Dallasites are challenged to perform 40 acts of kindness in 40 days beginning March 1 and running through April 9. Acts could include paying for a stranger’s cup of coffee or, something on a larger scale, such as volunteering at a food bank.

After each good deed, participants are to post a picture/description of what they did on social media sites using the hashtag #40AOK in hopes that what they do will inspire others to take action. Facebook, Twitter and Instagram posts with #40AOK are brought together on the website, http://www.40aokchallenge.com/.

The movement began in Dallas, but continues to spread across the nation.
